Creditor Bankruptcy Representation

Bankruptcy is a unique and complex area of the law, with its own language, code, rules, forms, and procedures, and the client will benefit from representation by an attorney whose practice in the Bankruptcy area is more than just a "casual" practice. Representing creditors in Bankruptcy matters presents different challenges, and requires a different perspective, from representing debtors. Attorney Robert A. DeMarco has been representing creditors in Bankruptcy cases since he started practicing in 1984, and exclusively represents creditors. Mr. DeMarco represents clients in Bankruptcy Chapters 7, 11, and 13, in all aspects of such cases, from the initial filing through discharge, filing all required pleadings, and litigating as required, including but not limited to:

  • Analysis and advice regarding the information contained in the Petition and Schedules;
  • Analysis and advice regarding the secured creditor's equity in collateral, and defense of attempts to "lien strip" or "cram down" the secured creditor's interest in the collateral;
